ONLINE AUCTION TERMS

PLEASE READ AND REVIEW THE TERMS THOROUGHLY PRIOR TO BIDDING. IF YOU HAVE NOT READ AND UNDERSTAND THESE TERMS PLEASE DO NOT BID. BY BIDDING ON THIS AUCTION, BUYER AGREES TO ALL TERMS AND CONDITIONS SET FORTH AND ENTERS INTO A CONTRACTUAL AGREEMENT TO PURCHASE THE ITEM(S) UNDER THE FOLLOWING TERMS AND CONDITIONS:

• 10% ONLINE BUYER'S PREMIUM AT THIS EVENT.

• Applicable sales tax will be added to final invoice.

• Shipping is NOT AVAILABE and will be at the buyer’s expense and direction. All other items must be picked up at scheduled times or by requested appointment. Any shipping will be AT BUYER'S EXPENSE

Payment may be made by cash-check-major credit card day of Auction – 4% convenience fee added to all credit card transactions. Payment must be received prior to removal of purchased items. On-line winning bids will be charged to the card used to register.

1. Catalog: Mason Auctioneers LLC has put forth every effort in preparing the catalog for this auction to provide accurate descriptions of all items. All lots are sold AS-IS, WHERE-IS, with all faults, imperfections, and errors of description. Due diligence is the responsibility of the bidder/buyer. Printed statements or descriptions by staff are provided in good faith and are matters of opinion.

2. Bidder Verification: The identity of all bidders will be verified, bidding rights are provisional, and if complete verification is not possible, Mason Auctioneers LLC. will reject the registration and bidding activity will be terminated.

3. Payments: All sales are final. All accounts must be settled at the conclusion of the auction. We accept Cash, Checks, Cashier/Bank Check, and Major Credit Cards. If paying by credit card, you will be charged for your purchases, plus a 4% Credit Card Fee and any applicable taxes. Credit card purchases are subject to card issuer/bank verification prior to payment and shipping. NOTHING will be charged to your card until a purchase is made.

4. Default of Buyer: Successful bidder not paying for items within 3 days of the date of the auction will be considered in default. Such default by the Successful Bidder will result in that Bidders liability to both the Seller and Mason Auctioneers LLC. Seller shall have the right to (a) declare this contractual agreement cancelled and recover full damage for its breach, (b) to elect to affirm this contractual agreement and enforce its specific performance or (c) Seller can resell the items either publicly or privately with Mason Auctioneers LLC. By registering and accepting a number, all bidders agree to abide by all the Terms of Sale. and in such an event, the Buyer shall be liable for payment of any deficiency realized from the second sale plus all costs, including, but not limited to the holding/transporting/storage costs of the items, the expenses of both sales, legal and incidental damages of both the Seller and Mason Auctioneers LLC. By registering and accepting a number, all bidders agree to abide by all the Terms of Sale. Inc. In addition, Mason Auctioneers LLC also reserves the right to recover any damages separately from the breach of the Buyer. The purchaser agrees to pay all reasonable attorney fees and costs incurred by Mason Auctioneers LLC in the collection of funds. The purchaser also agrees that a storage/handling fee of 2% per day be added to the balance of any unpaid balance due Mason Auctioneers LLC and any other costs or losses incurred by the Buyers failure to adhere to these terms. Any debt collection or dispute proceedings will be litigated or arbitrated in Logan County, Oklahoma at the option of both the Seller and Mason Auctioneers LLC. Both the Successful Bidder and Seller shall indemnify Mason Auctioneers LLC for and hold harmless Mason Auctioneers LLC from any costs, losses, liabilities, or expenses, including attorney fees resulting from Mason Auctioneers LLC being named as a party to any legal action resulting from either Bidders or Sellers failure to fulfill any obligations and undertakings as set forth in this contractual agreement.

5. Auctioneer Rights: All decisions of the Auctioneer are final. The Auctioneer reserves the right to reject any bid or bidder and has the right to accept back-up contracts the day of sale. Mason Auctioneers, LLC. has the sole authority to resolve any bidding disputes as they may arise. Mason Auctioneers, LLC. reserves the right to remove or cancel the bids and or bidding rights and privileges of any party, deemed not to be in the best interest of the seller, at any time.

6. PICKUP and SHIPPING: BUYER IS RESPONSIBLE FOR ALL PICKUP/HAULING/ SHIPPING. Mason Auctioneers LLC will not ship or be responsible for any shipping. Shipping arrangements must be made by the purchaser. Scheduling for the pickup of purchased items will be made at the conclusion of the auction. Once payment is complete, items should be picked up from the staging area during scheduled pickup times that are specified, or by appointment. If a buyer requests shipping they will have to arrange with a shipping company after the auction invoice is paid.

7. Bidding and Registration Information Bidder Verification: Bidding rights are provisional, and if identity verification is questionable, Mason Auctioneers LLC has the right to reject the registration, and bidding activity will be terminated. Mason Auctioneers LLC reserves the right to preclude any person from bidding if there is any question as to the person's credentials, mental fitness, etc. Bidders agree to keep their username and password confidential as they are responsible for ANY and ALL activity involving their account. When using the website or app you must obey any and all local state and federal laws. Violations will result in termination of web site use privileges.

8. Maximum Bid: When you bid your maximum bid, the current bid price does not automatically advance to your maximum bid. Another bidder has to bid to increase the current price, and the computer will automatically bid up to your maximum in the increments specified.

9. Auction End Times: This is a timed online auction. Bids are taken online only. Bidding will end when no bidding takes place within 3 minutes of the announced closing time. If any bids are recieved within 3 minutes of the closing time, the item will go into "overtime" until the time expires.

10. Technical Issues: In the event there are technical difficulties related to the server, software, internet or any other online auction-related technologies, Mason Auctioneers LLC reserves the right to extend bidding, continue the bidding, or close the bidding. Neither the company providing the software, nor Mason Auctioneers LLC shall be held responsible for a missed bid or the failure of the software to function properly for any reason.

11. Conduct of the Auction: Conduct of the auction and increments of bidding are at the direction and discretion of Mason Auctioneers LLC. Mason Auctioneers LLC reserves the right to reject any and all bids for any reason and also reserves the right to cancel this auction or remove any item or lot from this auction prior to the close of bidding. All decisions of Mason Auctioneers LLC are final. Your bid on this auction indicates both an understanding and an acceptance of the terms of this contractual agreement between yourself and both Mason Auctioneers LLC and the Seller and that you, as the Bidder, are prepared to purchase items under these terms and conditions.

12. All Sales are Final: By registering and bidding, the buyer acknowledges they understand and agree to the Terms of Sale. The Buyer acknowledges that they have read the Auction Purchase and Sale Agreement, and the Terms and Conditions of the Auction Sale provided by Auctioneer and accept the Auction Purchase and Sale Agreement without any changes to the preprinted text.

13. Representation: Although information has been obtained from sources deemed reliable, the Auctioneers, Mason Auctioneers, LLC., its representatives, employees, firm, broker, their attorney’s nor the Seller make any guarantee or warranty of any kind expressed or implied as to the accuracy of the information herein contained.

14. Property: The property, offered for sale at the Auction is being sold “AS IS”, “WHERE IS”, WITH ALL FAULTS AND DEFECTS”, without warranty or guarantee of any kind, except as expressly provided for in the Auction Purchase and Sale Agreement and Terms and Conditions of the Auction Sale. Each potential Buyer is encouraged to perform his/her own independent inspections, inquiries and due diligence concerning the described property. The information is being furnished to bidders for the bidder's convenience and it is the responsibility of the bidder to determine that information contained herein is accurate and complete. Any reliance on the contents shall be solely at the recipient's risk. It is the Buyer’s responsibility to inspect the property prior to bidding to make their determination as to the condition or seek professional inspection (at the Buyer’s expense) of the property. All information is taken from sources deemed to be accurate and reliable, all measurements are approximate and not to scale. The Seller and the Auctioneers, Mason Auctioneers, LLC., contractors, employees, firm, or brokers assume no liability in this matter. Any and all announcements made the day of auction take precedence over any and all previously written advertisements or any prior written or verbal terms of sale but shall in no event form the basis of any representation or warranty by Seller or Auctioneers. By bidding on the property, you are accepting all terms and conditions stated herein.

BY REGISTERING TO BID, YOU HAVE ACKNOWLEDGED:

• I have read, understand and agree to all of the terms and conditions.

• I understand that I do not have an agency relationship with Mason Auctioneers, LLC., auctioneers, firm, broker and all parties employed by or associated with.

• I accept full responsibility for due diligence on the items I am bidding on.

• I understand that all items will be sold “As-Is, Where-Is”.

• I understand that, in the event I am the successful bidder, that a 10% Buyers Premium will be added to the high bid.
